Mojang Declares Paid For Ranks Illegal And Premium Replacement Idea

To add to this games like Gary's mod have had some of the player created games made on the main games client claimed by the devs because of how popular they got. Some private pay to play servers who supplied these player created games had all the money that was earned by the server taken because of this law.
Just to fix part of this: these servers also had a premium system which works in the same sort of donation for 'thank you gift' system

...notice that Mojang didn't say word-one about server donations for the past several years. Not until they realized how much capital they were missing out on and created "Realms" in hopes of capturing some of that money. Now that Realms is available in all countries, suddenly something that was never even discussed has become "against terms of service".

Sounds like a cash grab to me.

Now as for the content of this video: I think there is a very strong part of the video that nearly everyone is ignoring. The representative clearly states that reselling parts of the game are illegal by the terms of service. MassiveCraft doesn't resell any feature created by Minecraft, perhaps with the exception of the ability to ride skeletal horses. All premium features are features generated trough Massivecraft plugins, or secondary plugins. In effect as such, MassiveCraft is not selling parts of Minecraft, but using Minecraft as a gateway to hand out it's own resources for a donation.
However, Marc Watson has stated that "You have never been able to sell mods. Not previously. Not now." I know these are plugins, but I think the same rules might apply. Please don't be angry at me. I am only trying to help. Though you are donating, often, many servers call VIP a donator rank. It is still a rank, seeing as how you receive it through paying money and get some sort of part of the game out of it. Even a player made part, like a mod or plugin.

Legally there is a difference between a purchase and a donation, so technically there is no purchase of Mojang property in the way the premium donations are done so their terms should not be violated in any way. Anyone is within their own right to give a "gift" and this is what the donation feature acts as, hence there should not be an issue.

๖ۣۜWell, to be fair, it was brought to attention through news and the big issue of hacking and all recently. If they wanted a cash grab, they would have accepted their previous deal with Oculus, which would have landed them probably more money than realms will be at first. Plus, they aren't focusing on donating, they're focusing on (As said before) when people are selling parts of the game itself, not parts of the plugins.

I think this thread should be locked or completely deleted, as to not freak out more people before they read the responses like myself. This thread nearly killed me.

It would also be nice if a post on the website explaining what's happened and how it's not too much of an issue would be nice. People should see it as a mere 'heads up' or 'keep this in mind' rather than a 'this is happening and we need to solve it immediately' piece of news.

Don't Die!!! But seriously, I did not mean to startle anyone. I merely wanted to give out some news that not a lot of people knew and was trying to help them come up with ideas to avoid stuff.

I'm not criticizing. I'm just stating my opinion, which, in this case, is to boop this on the website @-@

Mojang could flick a switch and switch off multiplayer untill all server owners agree not to have "pay for ranks". Then they could program bots onto sites like planetminecraft to find premium/VIPs advertisements.

Let's hope that MassiveCraft stays away from things like this. This is a screenshot of an actual server donation page. No information about the server is given, so I think this is legal :P

Quite often, many servers call ranks "Donations." The idea is this for premium: If you pay us money, you help out our server a lot! We will love you forever. Have these perks.
That was a gross over simplification. I understand that premiums are what make Aloria go round. I would say that, just to be safe, you guys should ask Marc before assuming anything. But the idea of premium is an incentive to help the server to most people. I would love premium myself, but I got no moniez! The money goes to fund the server, but it is still money for an in-game feature. You can call it a gift, and it is, but so is a rank. You pay 10 dollars to donate, but you also vet the rank of VIP and the ability to use diamond stuff. That is not only selling an in game feature, but selling a rank from a plugin which is protected under Mojang's ownership. Mods or plugins is still selling something for their game. Just like, for example, if someone makes DLC for Smash Bros. and charges $10 for it, that is illegal. It is making money using someone else's code. The plugins operate with some of the basics of the Minecraft code. Like entering commands, tools, blocks, etc.

@indyfan98 I know you are being helpful and I thank you for sharing the original article but you are crossing the line between helpful and harmful and this is starting to get the community alarmed over nothing you have politics over. Please lets all get back to playing and let this develop. The team at MassiveCraft ultimately have the role of watching this and acting accordingly.

This goes for everyone too.

Non premiums have been able to use diamond armor for a long time now :P

If you would read the entire thing it also states that mojang has no issue with donations its the actual purchase of ranks that you see on high pvp servers that he is referring to. We have a DONATION button. You DONATE, we can choose to change the donation perks at any time. It also states that in the donation part. You are making an avalanche out of a snowball trying to freak the community out by making a bigger issue then it is. We also do NOT have any perks that are vanilla minecraft as marty stated. Everyone can wear diamond armor even non premiums so please get your facts straight before causing an uproar. We have tried to explain this to you calmly many times now from many different sources of staff. If you dont get it by now you simply wont get it. As this is starting to antagonise the staff and the players that realise that this is nothing we have to worry about at this moment i am requesting you let it go now. If Mojang changes it TOS we will analyse the change and act accordingly. We however have NO indication that they will go after donation servers. Now let it go....

While I see your point, I don't think he's trying to freak out the community (He said it himself in multiple posts), and it was rather rude how you presented that point over and over. All he was trying to do is alert the community and try to play the devil's advocate, just trying to see things through a different point of view is all, since it helps to produce more helpful conversation. I wouldn't view what he's doing in a negative light, that's all I mean :P

They will use that exception against us. It is still a vanilla entity and they will use that against the server. I suggest you make it available to all players before they really do something about it.
They said in almost every source posted that they are not actively hunting servers though

Don't worry, they will go after pvp.net and such servers first before they take on medium sized servers like MassiveCraft. Before that time comes, we will have taken plenty of precautions.

Actually im not being rude but when we have explained our stance 10 times over from different staff saying it differently and hes still going at the same point and not listening then who is infact being rude?

Like I said, he is trying to look at things from a different point of view intentionally, I think he has received everyone's points well. He's just the messenger, don't shoot him :P

Locking thread. Plenty of assurances have been given, anyone attempting to continue this discussion is seen as attempting to unnecessarily scare mongering, and actions will be taken against them.
